SMS Texting Terms and Conditions of Use
Flowing Brooks Enterprises, LLC™ uses SMS to send text messages about client appointments, consultation updates, and firm news. Please review our SMS Texting Terms and Conditions to learn more about SMS text messaging. Flowing Brooks Enterprises, LLC™ reserves the right to modify these Terms and Conditions at any time. Your continued use of this text messaging communication will constitute your acceptance of the new terms.
If you choose to opt-in to receive text messages from Flowing Brooks Enterprises, LLC™, you agree to abide by the following mobile texting terms and conditions.
Opt In
You may opt into text messages on our website (flowingbrooks.com), via a form we email you, or verbally through conversation with our principal management consultant, Jeanniece Jackson. After you opt in, you will have an opportunity to confirm or decline your participation in SMS via a reply to an initial text message you receive from Flowing Brooks Enterprises, LLC™.
Authorization
You represent that you are the subscriber for or authorized user of the phone number that you provided in opting-in to receive text messages from Flowing Brooks Enterprises, LLC™, and that you are authorized to approve any related charges for messaging and data applied by your wireless carrier. You agree to promptly notify Flowing Brooks Enterprises, LLC™ at support@flowingbooks.com if service for any phone number provided by you is cancelled or if your phone number changes, so that Flowing Brooks Enterprises, LLC™ may update its records.
Messaging Costs
Flowing Brooks Enterprises, LLC™ does not charge for SMS, however, message and data rates may apply from your mobile carrier. When you opt in to receive text messages, you are responsible for any carrier fees such as data plan charges, text messaging charges, tolls, out-of-area roaming, and other charges. Messaging frequency will vary.
Automatic Telephone Dialing Systems
Flowing Brooks Enterprises, LLC™ may use an automatic dialing system to deliver text messages to you. The Federal Communications Commission generally defines an “automatic telephone dialing system” or autodialer as equipment that has the capacity to store or produce telephone numbers to be called and to call such numbers. By your subscription to SMS, you give your consent to Flowing Brooks Enterprises, LLC™ to use an automatic dialing system to deliver text messages to the telephone or cell phone number to which you have directed Flowing Brooks Enterprises, LLC™ to auto transmit text messages.
Carriers
Note that SMS communications from Flowing Brooks Enterprises, LLC™ may not be available through all mobile carriers.
Quality and Security
Please note that text messages may be delayed. Flowing Brooks Enterprises, LLC™ does not guarantee the timeliness, accuracy, completeness or receipt of text messages transmitted through its mobile texting. Text messages are transmitted by telecommunications service providers over whom Flowing Brooks Enterprises, LLC™ has no control.
All mobile texting is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of performance, availability, quality of service or fitness for a particular purpose. Flowing Brooks Enterprises, LLC™ makes no warranty that mobile texting will be uninterrupted, error free, accurate or complete. You further agree that all use of the service is at your sole risk. Without limiting the foregoing, Flowing Brooks Enterprises, LLC™ does not make any warranties as to the security of your communications. You have the sole responsibility to secure your communications.
Opt Out
Reply stop to the text message you received to stop receiving text messages from SMS. Or send email to support@flowingbrooks.com to opt out. By enrolling in SMS, you consent that following such a request to unsubscribe, you may receive one final message from SMS confirming that you have stopped text messages from SMS and will receive no further text messages unless you provide consent to it.
Privacy Statement
Flowing Brooks Enterprises, LLC™ values the privacy of every client and stakeholder of Flowing Brooks Enterprises, LLC™. Our Privacy Statement and Principles, available at flowingbrooks.com/privacypolicy, explains how we collect, use, and share your personal information. Flowing Brooks Enterprises, LLC™ will not ask you for, nor should you provide, personal information, passwords, or any other confidential or sensitive information in text messages.

Termination
Flowing Brooks Enterprises, LLC™ reserves the right, in its sole discretion, to suspend or terminate mobile texting at any time, in whole or in part, for any reason, with or without notice to you.
Indemnification
To the maximum extent permitted by law, you expressly understand and agree that Flowing Brooks Enterprises, LLC™ and/or its affiliates, officers, agents, employees, partners, contractors, consultants, and suppliers (“Flowing Brooks Enterprises, LLC™ Related Parties”), shall not be liable to you or any other person for any losses, costs, expenses or damages of any kind based on breaches of these terms and conditions or your relationship with Flowing Brooks Enterprises, LLC™, regardless of the type or basis of the claim. In no event will Flowing Brooks Enterprises, LLC™ or the Flowing Brooks Enterprises, LLC™ related parties be liable for any direct, indirect, incidental, special or consequential damages, including attorney’s fees, arising out of the use of or inability to use mobile texting.
Venue
These mobile texting terms and conditions and Flowing Brooks Enterprises, LLC™’s relationship with you regarding mobile texting are governed by the laws of the state of Ohio, without regard to its conflicts of law principles, and venue for any suit or dispute regarding these mobile texting terms and conditions shall be brought in Ohio.
